Sex Establishments are required to be licensed under the Local Government (Miscellaneous Provisions) Act 1982.
Anyone wishing to open one of these establishments has to present an application before the Council’s Licensing Committee, which Council Officers and the Police can put their views across to whether the licence is issued.
An applicant must send a copy of the application to the Police, put a public notice in a local newspaper within 7 days of making the application and display a notice on the premises intended to be used as a Sex Establishment for 21 days as from the date of application.
When considering an application for a sex establishment licence the Council may only use the following criteria:
- the suitability of the applicant
- whether the person applying is a "front" person for someone else
- the location and situation of the premises in relation to other premises in the area
- whether the number of sex establishments in that locality is equal to, or exceeds the number which the Council considers appropriate for the area

A fee is payable upon application which may last for a year or such shorter period as is determined by the Council’s Committee. Please refer to the Schedule of Fees

Any change in circumstances must be notified to the authority.
Licences last for 1 year and application to renew the licence must be received before the current licence expires.
